Spratling Silver ("we", "us", or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains what information we collect when you visit spratlingsilver.mx or place an order, how we use and safeguard it, and the rights you have over your information. It is written to comply with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, "LFPDPPP") and applicable United States privacy laws, including the California Consumer Privacy Act as amended (CCPA/CPRA).
Who We Are (Data Controller)
This store is operated by Spratling Silver Inc. (1550 Broadway, Suite F, Chula Vista, CA 91911, United States), a handcrafted silver atelier continuing the original workshop established by William Spratling in 1931 in Taxco, Guerrero, Mexico (workshop: Carretera Nacional 95 km 177, Taxco el Viejo, Guerrero). We are the party responsible for the personal data we collect (the data controller / responsable). For any privacy question or request, contact us by email at info@spratlingsilver.mx or by WhatsApp at +52 56 3468 5983. We respond within 48 hours.
Information We Collect
- Information you provide: your name, shipping and billing address, email address, a phone number if you choose to give one, order and sizing details, payment confirmation, and any messages you send us.
- Information collected automatically: device and browser type, IP address, pages viewed, referring website, and similar usage information, collected through cookies and comparable technologies.
- Information from third parties: our payment processors confirm your payment (we never receive your full card number), and our shipping carriers provide delivery and tracking status.
We do not knowingly collect special-category or sensitive personal data, and we do not knowingly collect information from anyone under 18.
How We Use Your Information
- To process, produce, ship, and confirm your made-to-order purchase;
- To communicate with you about your order, including production progress updates;
- To respond to your inquiries and provide customer care;
- To send marketing emails only where you have consented, and from which you may unsubscribe at any time;
- To detect and prevent fraud and to keep our store secure;
- To comply with legal, tax, customs, and accounting obligations in Mexico and in your destination country;
- To maintain and improve our website and our pieces;
- To maintain our voluntary provenance registry: if you choose to register a piece, we record the name, email, and optional phone/location you submit. Only your initials and city are ever displayed publicly.
Legal Basis & Consent
We process your data to perform our contract with you (your order), to comply with our legal obligations, for our legitimate interest in operating and securing our business, and — for marketing and non-essential cookies — on the basis of your consent, which you may withdraw at any time.
Cookies & Tracking
We use cookies and similar technologies that are strictly necessary to operate the store (for example, to keep items in your cart and to process checkout), together with optional analytics and marketing cookies. You can control or disable cookies through your browser settings, and where required we will ask for your consent before setting non-essential cookies. Disabling essential cookies may affect how the site functions.
How We Share Your Information
We do not sell your personal information for money. We share information only as needed with:
- Service providers who operate our store and fulfil your order — including Shopify (our e-commerce platform), our payment processors, our shipping carriers (such as DHL and FedEx), and our email and analytics providers — each permitted to use your data only to provide their service to us;
- Authorities or advisors when required by law, or to protect our rights, your safety, or the integrity of our store;
- A successor entity in the event of a merger, acquisition, or sale of assets, subject to this Policy.
Under certain U.S. state privacy laws, the use of analytics or advertising cookies may be treated as a "sale" or "sharing" of personal information. You may opt out at any time — see "Your Rights (United States)" below or our Your Privacy Choices page.
International Data Transfers
We are based in Mexico and serve customers in the United States, Canada, Europe, and elsewhere. Your information may therefore be processed in Mexico, the United States, and other countries where we or our service providers operate, whose data-protection laws may differ from those of your country. We take reasonable steps to ensure your data remains protected wherever it is processed.
Data Retention
We keep your personal data only for as long as necessary to fulfil your order, provide after-sales care (including our craftsmanship guarantee), and meet our legal, tax, and accounting obligations. When it is no longer needed, we securely delete or anonymize it.
Security
Payments and account data are transmitted over encrypted connections, and we apply administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No method of transmission over the internet is perfectly secure, but we work to protect your information and to notify you and the relevant authorities of any data breach as required by law.
Your Rights in Mexico (LFPDPPP / ARCO)
If you are in Mexico, you have the right to Access, Rectify, Cancel, and Oppose the processing of your personal data (your "ARCO" rights), as well as to revoke your consent and to limit the use or disclosure of your data. To exercise any ARCO right, email us at info@spratlingsilver.mx with your name, a description of your request, and a means of verifying your identity. We will respond within the timeframes set by the LFPDPPP. This Privacy Policy also serves as our Aviso de Privacidad (Privacy Notice) under the LFPDPPP.
Your Rights (United States / California)
If you are a U.S. resident, depending on your state you may have the right to:
- Know what personal information we collect and how we use and disclose it;
- Request a copy of the personal information we hold about you;
- Request correction or deletion of your personal information;
- Opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising;
- Be free from discrimination for exercising any of these rights.
To exercise these rights, email info@spratlingsilver.mx or visit our Your Privacy Choices page. We will not charge you, or deny you products or service, for making a privacy request, and we will verify your identity before acting on it. We do not sell the personal information of consumers we know to be under 16 years of age.
Marketing Communications
We send marketing emails only to people who have asked to hear from us. Every marketing email includes an unsubscribe link, and you may opt out at any time by clicking it or by emailing us. Transactional messages about your order (such as confirmations and production updates) are not marketing and will continue to be sent.
Children's Privacy
Our store is intended for adults. We do not knowingly collect personal data from anyone under 18. If you believe a minor has provided us with personal data, please contact us and we will delete it.
Third-Party Links
Our website and emails may link to other sites (for example, museum or press references). We are not responsible for the privacy practices of those sites, and we encourage you to review their policies.
Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised version on this page with a new "Last updated" date, and we will communicate significant changes where appropriate. Your continued use of our website after changes are posted constitutes acceptance of the revised Policy.
